Allyn Jaffrey Shulman Analyzes the Unlawful Internet Gambling Act
October 07, 2006Allyn Jaffrey Shulman wants to make it clear that the Unlawful Internet Gambling Act doesn't make online poker illegal! It doesn't! The new bill just makes it more difficult to get money into a site because it forbids US financial institutions from funding the type of online gambling that the law previously made illegal. Poker was NOT a part of that law...so, it is technically not a part of this law either!

The bill only enforces laws already in existence. Since there was no law previously outlawing poker, then it's not illegal now. I repeat - playing online poker is NOT illegal now!
According to previous legislation, most notably the 1961 Wire Act, sports betting is illegal. Poker is NOT! Sure, the US Attorney General's office maintains that online poker is illegal, but there's no legal proof for that line of thinking. Also, they have NEVER brought a case against an online poker provider in the decade these sites have been in existence/
Allyn urges people not to get hysterical about the impending legislation and to take the time to read the act in its entirety. Here's the link to that!
The other important point she makes is regarding jurisdiction. The United States has NO control over what offshore companies do. Most poker sites are based out of the United States (if not all). Therefore, our government can't make rules concerning how they operate!
